Mayor Hoffman called the meeting to order and declared a quorum present to conduct business.
2. Roll Call. A roll call reflected that the above listed members of the Council were present. Council members expressed their appreciation to Susan Marshall and the Nichols Hills Parks, Inc. for the beautiful light displays within the parks. 3. PUBLIC HEARING: Discussion, Consideration and Possible Approval or disapproval on Case PC 2012-12-02 for which the owners of 1700 Wilshire Boulevard are requesting to erect a fence higher than allowed by code. This property is currently zoned E-1. Following the presentation by applicant, Mayor Hoffman opened the public hearing. Dr. Imes and Ms. Kay Kuykendell were among the residents speaking in support of the applicant. Seeing no others, the public hearing was closed. Motion was made by Clements to move item 7, seconded by Goetzinger. AYE: Hoffman, Goetzinger, Clements NAY: None 8. PUBLIC HEARING: Discussion, Consideration and Possible action recommending the amendment of Section 25-57 regarding landscaping requirements for all zoning districts. Mayor Hoffman opened the public hearing, seeing that no one expressed a desire to speak, the public hearing was closed. Motion was made by Goetzinger to move item 8 to include the ordinance as presented and modified. The motion was seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 9. PUBLIC HEARING: Discussion, Consideration and Possible Approval or disapproval to consider adoption and enactment of a new code of ordinances of the City, published in 2012 by Municipal Code Corporation, entitled “Nichols Hills City Code, 2012,” also called Nichols Hills City Code. Mayor Hoffman opened the public hearing, seeing that no one expressed a desire to speak, the public hearing was closed. Member Clements moved item 9, seconded by Goetzinger. PUBLIC HEARING: Discussion, Consideration and Possible Approval or Disapproval of amendments to the Nichols Hills Code regarding building setbacks on corner lots. Mayor Hoffman opened the public hearing, seeing that no one expressed a desire to speak, the public hearing was closed. Motion was made by Goetzinger to continue this item to the regularly scheduled city council meeting in February 2013, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 11. PUBLIC HEARING: Discussion, Consideration and Possible Approval or disapproval on Case PC 2012-08-01 for which the owners of 1601 Guilford are requesting to erect a fence in front of their home and by ordinance, can only do so by review. This property is currently zoned E-1. Mayor Hoffman opened the public hearing, seeing that no one expressed a desire to speak, the public hearing was closed. 12. Discussion, Consideration and Possible approval or disapproval of Amendment No. 1, Change Order No. 1 in the amounts of $7,975 and $2,850, respectively, for Project No. PC-1201 to A-Tech Paving for the Wilshire Boulevard paving improvements. This increases the original contract amount to $2,292,667.80, to be paid out of the 2010-2011 GO Bonds and other funds. Motion was made by Goetzinger to move item 12, seconded by Clements. 13. Discussion, Consideration and possible approval or disapproval of Pay Estimate No. 1 for Project No. PC-1001, Wilshire Boulevard Paving Improvements in the amount of $188,675.36 to A-Tech Paving. To be paid out of the 2010-2011 GO Bonds and other funds. Motion was made by Clements to move item 13, seconded by Goetzinger. AYE: Hoffman, Goetzinger, Clements NAY: None
14. Discussion, Consideration and possible action authorizing Allied Arts to install banners within the City of Nichols Hills between February 4, 2013 to February 15, 2013. Motion was made by Goetzinger to move item 14 subject to posting bond of $10 per pole for which banners will be placed, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 15. Discussion, Consideration and possible action regarding request from April Littleton permitting the placement of a residential care home within the R-1-75 zoning district within the city limits of Nichols Hills. Following presentations by Ms. Littleton, Dr. and Mary Hauser, and discussion among council members, city attorney and staff, a Motion was made by Goetzinger to table item 15, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 16. Discussion, Consideration and possible approval or disapproval of recommendation from EHSC to close the City of Nichols Hills Recycling Center. Chairman Herzel to address council. EHSC Chairman Nancy Herzel presented council members with historical recycling efforts in Nichols Hills, followed by the EHSC recommendation to close the Nichols Hills Recycling Center. Motion was made by Clements to move item 16, seconded by Goetzinger. AYE: Hoffman, Goetzinger, Clements NAY: None 17. Discussion, Consideration and possible action regarding Earth Day 2013, requesting to be held on April 20, 2013. Representatives from Planet Nichols Hills to address council. Nancy Herzel, representative of Planet Nichols Hills, advised council of the request to hold the 2013 Earth Day celebration on April 20, 2012. Motion was made by Goetzinger to move item 17, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 18. Discussion, Consideration and possible action regarding temporary placement of inflatable toys in Nichols Hills Parks. Motion was made by Clements to move to instruct staff to prepare an ordinance to prohibit inflatable toys in the Nichols Hills Parks, seconded by Goetzinger. 19. Discussion, Consideration and possible action to award bid for sale of 1998 Fire Engine 1, and award bid to highest bidder as recommended by Fire Chief Terry Hamilton. Motion was made by Goetzinger to move item 19, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 20. Discussion, Consideration and Possible approval or disapproval of Amendment No. 2 in the amounts of $59,693.82, for Project No. PC-0901 & WC-1003 to Atlas Paving for the Dorchester Place and Camden Way Paving, drainage and water improvements. This increases the original contract amount to $1,320,611.44, to be paid out of the 2008-2009 GO Bonds and other funds. Motion was made by Clements to move item 20, seconded by Goetzinger. 21. Discussion, Consideration and possible approval or disapproval of Pay Estimate No. 11 for Project No. PC-0901 & WC-1003 for the Dorchester Place and Camden Way Paving, Drainage and Water Improvements project in the amount of $63,151.74 to Atlas Paving. To be paid out of the 2008-2009 GO Bonds and other funds. Motion was made by Goetzinger to move item 21, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None 22. Discussion, Consideration and Possible Action regarding Christmas bonus for City Employees. Motion was made by Clements to move item 22, seconded by Goetzinger. Motion was made by Goetzinger to move item 23 authorizing a 5% cost of living adjustment for all employees and authorizing funding, seconded by Clements. AYE: Hoffman, Goetzinger, Clements NAY: None
24. Discussion, Consideration and Possible Action to allow Public Works to solicit bids for entry markers, not to exceed $32,000 as budgeted in 2012-2013 CIP. Motion was made by Clements to move item 24, seconded by Goetzinger. AYE: Hoffman, Goetzinger, Clements NAY: None 25. Adjournment. There being no further business, Goetzinger made a motion to adjourn this meeting, which was seconded by Clements, which was unanimously approved.
