1.   Call to Order.  Mayor Hoffman called the meeting to order and declared a quorum present to conduct business. 

 

2.   Roll Call.  A roll call reflected that the above listed members of the Council were present.

6.      Citizens desiring to be heard.

 

 

7.      Consider and approve a resolution establishing a financing plan; authorizing the publication of a notice of public hearing; authorizing the city manager to negotiate a bond purchase agreement for the issuance of general obligation refunding bonds; authorizing staff to go forward with the development of the financing, including preparation of a preliminary official statement and action related thereto.

 

Motion to approve the resolution establishing a financial plan, authorizing staff, City Manager and City Attorney was moved by Clements, and seconded by

8.      PUBLIC HEARING: Discussion, Consideration and Possible Enactment of an ordinance regarding distributed antenna systems; amending Section 25-52.020 of the Nichols Hills City Code adding and removing definitions; amending section 25-52.030 of the Nichols Hills City Code relating to special use permits; adding a new subsection to section 25-52.030 of the Nichols Hills City Code to regulate placement of distributed antenna systems; amending section 25-52.040 of the Nichols Hills City Code removing certain antenna structures available without special use permits, making provisions severable, and declaring an emergency.

 

Following an update provided by staff, Mayor Hoffman opened the public hearing. Mr. Elby Beal addressed council with questions regarding the properties for which this ordinance applies. Seeing no others desiring to speak, the public hearing was closed.

 

Motion to approve this ordinance was made by Clements, and seconded by Goetzinger.

a)      Consider, discuss and approve or disapprove the emergency section of the foregoing ordinance.

 

MOTION:  Goetzinger moved that the Council approve the emergency section of the foregoing ordinance total warrants and claims as presented.  Clements seconded this motion.

Motion to request Planning Commission to discuss and consider possible amendments of the Nichols Hills Tower ordinances with specific reference to property owned by the municipality and towers at least 300 feet from residentially zoned district was moved by Clements, and seconded by Goetzinger.

9.      PUBLIC HEARING:  Discussion, Consideration and Possible Approval or disapproval on Case PC 2012-08-01 for which the owners of 1601 Guilford are requesting to erect a fence in front of their home and by ordinance, can only do so by review.  This property is currently zoned E-1.

 

City Manager advised the owner has passed, and property has been sold with the closing to be held on Friday, November 13, 2012.  Mayor Hoffman opened the public hearing for case PC 2012-08-01, seeing no one expressing a desire to speak, the public hearing was closed.

 

 

Motion to continue this public hearing to the regular scheduled meeting on November 13, 2012 at 5:30 p.m. was made by Clements, and seconded by Goetzinger.    

 

10.  Discussion, Consideration and Possible Approval or Disapproval of a Resolution amending the City’s Investment Policy to provide an exception to the provision which limits the percentage of investable funds which may be placed in a single depository institution.

 

MOTION:  Goetzinger moved that the Council approve the amended investment policy resolution as presented.  Clements seconded this motion.

11.  Discussion, Consideration and possible action on report of home-side recycling services to be presented by Environmental, Health and Sustainability Commission Chairman Nancy Herzel.

 

 

Nancy Herzel, Chairman of Environmental, Health and Sustainability Commission for the City of Nichols Hills, announced the new house-side recycling to begin in November 2012.  A private company “Recycling the Hills” will begin house-side recycling for residents desiring to enter in a business relationship with the company.  The Mayor and Ms. Herzel advised the City is not endorsing this business, simply advising that a solution is being offered to residents desiring to recycle.

 

MOTION:  Goetzinger moved to accept the EHS Chairman’s report as presented.  Clements seconded this motion.

12.  Discussion, Consideration and Possible approval or disapproval of Amendment No. 1, Change Order No. 1 in the amounts of $<7,618.96> and $14.880.00, respectively, for Project No.  WC-1201 to Urban Contractors for the water line replacement project.  This amendment increases the original contract amount to $81,852.04, to be paid out of the 2012 GO Bonds and other funds.

 

MOTION:  Clements moved that the Council approve Amendment No. 1, Change Order No. 1 increasing the original contract amount to $81,852.04.  Goetzinger seconded this motion.

13.  Discussion, Consideration and possible approval or disapproval of Final Pay Claim for Project No. WC-1001, Well Line Replacement in the amount of $81,852.04 to Urban Contractors. To be paid out of the 2008-2012 GO Bonds and other funds. 

 

MOTION:  Goetzinger moved the approval of Final Pay Claim to Urban Contractors for the WC-1001 - Well Line Replacement project. Clements seconded this motion.

14.  Discussion, Consideration and possible approval or disapproval of Pay Estimate No. 10 for Project No. PC-0901 & WC-1003 Dorchester Place and Camden Way Project in the amount of $25,984.10 to Atlas Paving Co. To be paid out of the 2008-2009 GO Bonds and other funds. 

 

 

MOTION:  Clements moved the approval of Pay Estimate No. 10 for project No. PC-0901 & WC-1003 Dorchester Place and Camden Way Project.  Goetzinger seconded this motion.

15.  Discussion, Consideration and Possible Approval or disapproval of ordinance #976 amending Section 10.5-36 the Nichols Hills City Code relating to water meter installation and service charges; repealing all conflicting ordinances or parts of ordinances; providing for severability; and declaring an emergency.

 

 

MOTION:  Clements moved to approve ordinance #976 amending Section 10.5-36 relating to water meter installation and service charges, as presented.  Goetzinger seconded this motion.

16.  Discussion, Consideration and Possible Approval or disapproval of an ordinance amending Chapter 25 of the Nichols Hills City Code regarding setback requirements for combined lots; repealing all conflicting ordinances or parts of ordinances; providing for severability; and declaring an emergency.

 

MOTION:  Clements moved the approval of the ordinance amending Chapter 25 regarding setback requirements for combined lots, as presented.  Goetzinger seconded this motion.

17.  Discussion, Consideration and Possible Approval or disapproval of OMRF disability retirement application submitted by Leonard Smith Jr.

 

MOTION:  Clements moved that the Council approve the disability retirement application for Mr. Leonard Smith, Jr.  Goetzinger seconded this motion.

18.  Discussion, Consideration and possible approval or disapproval of request from Theta Flaming Festival to hang approximately 20 banners in all four directions of the intersection of Grand Boulevard and Pennsylvania Avenue.

 

MOTION:  Goetzinger moved approval of request from Theta Flaming Festival to hang banners. Clements seconded this motion.

19.  Discussion, Consideration and Possible Enactment of an ordinance requiring permanent signs to stop traffic from all directions be placed and maintained at the intersection of Dorset Drive and Elmhurst Avenue; providing of severability; and declaring an emergency.

 

MOTION:   Clements moved the approval of this ordinance, seconded by Goetzinger.

20.  Discussion, Consideration and Possible action regarding detrimental conditions of property at the following locations: 1610 Wilshire; 6616 Avondale Drive and 2001 Huntington.

 

Motion to direct staff to investigate each of these properties and at a future meeting propose possible remedies, was moved by Clements, and seconded by Goetzinger.

21.  Discussion, Consideration and Possible approval or disapproval to purchase a Backhoe for Public Works.

 

Motion to approve the backhoe purchase for Public Works was moved by Goetzinger, and seconded by Clements.

22.  Discussion, Consideration and Possible approval or disapproval of Budget Adjustment number 2 for fiscal year 2012 – 2013.

 

Motion to approve the budget adjustment was moved by Clements, and seconded by Goetzinger.

23.  Discussion, Consideration and possible approval or disapproval to purchase two 2013 Ford Escape vehicles for Public Works Administration. Cost will not exceed $37,000, and was approved in the FY 2012-2013 CIP budget.

 

Motion to approve the purchase of two 2013 Ford Escape vehicles for public works was moved by Clements, and seconded by Goetzinger.

24.  Adjournment. There being no further business Goetzinger made a motion to adjourn this meeting, which was seconded by Clements, which was unanimously approved.
