1. Call to Order. Mayor Hoffman called the meeting to order and declared a quorum present to conduct business. Mr. Tom Hughes, Mr. William Roten with Boy Scout Troop 120 and Mr. Elliott Armitage Boy Scout Troop 193 lead the flag salute.

7. PUBLIC HEARING: Discussion, Consideration and Possible Approval or disapproval on Case PC 2012-08-01 for which the owners of 1601 Guilford are requesting to erect a fence in front of their home and by ordinance, can only do so by review. This property is currently zoned E-1

PUBLIC HEARING: Application by Glenbrook Park in Nichols Hills, LLC for approval of a final plat for Glenbrook Park in Nichols Hills regarding property at 1601 NW 63rd Street, Nichols Hills, Oklahoma, in the North Half of Section Five (5) Township Twelve (12) North, Range Three (3) West of Indian Meridian, Oklahoma County, Oklahoma.
A. Discussion, Consideration and Possible Approval or Disapproval of the forgoing Final Plat.
Motion to continue this public hearing to the regular scheduled meeting on September 11, 2012 at 5:30 p.m. was made by Clements, and seconded by Goetzinger.

9. PUBLIC HEARING: Discussion, Consideration and Possible approval or disapproval of Nichols Hills Plaza South site design proposal, within the Town Center Overlay District.
Motion to approve the Nichols Hills Plaza South site design proposal, within the Town Center Overlay District and determining it is a minor change to the Town Center Overlay District was made by Clements, and seconded by Goetzinger.

10. Discussion, Consideration and Possible Action to approve April 6, 2013 and April 7, 2013 as tentative Redbud Classic dates.

12. Discussion, Consideration and Possible approval or disapproval of policy to implement a No Tobacco Products in Parks and Playgrounds within Nichols Hills, as recommended by Nichols Hills Environment, health, and Sustainability Commission.
MOTION: Goetzinger moved that the Council approve to change the word “prohibited” to “discouraged” the No Tobacco Products in Parks and Playgrounds policy within Nichols Hills, as recommended by Nichols Hills Environment, Health, and Sustainability Commission. Council requested a copy of the revised policy be included with the minutes. Clements seconded this motion.

NO TOBACCO PRODUCTS IN PARKS AND PLAYGROUNDS POLICY FOR THE CITY OF NICHOLS HILLS
1. Use of tobacco products is a proven health threat to children, adults, and animals and sets an unhealthy example for children. Therefore, use of all tobacco projects is hereby discourages in the City of Nichols Hills parks and playgrounds.
2. For purposes of this section, City of Nichols Hills parks and playgrounds shall be defined as any portion of public land set aside designated as a park.
3. Signs will be erected in the City of Nichols Hills parks and playgrounds reflecting the policy of discouraging tobacco product use.
13. Discussion, Consideration and possible approval or disapproval of Pay Estimate No. 9 for Project No. PC-0901 & WC-1003 Dorchester Place and Camden Way Project in the amount of $98,248.74 to Atlas Paving Co. To be paid out of the 2008-2009 GO Bonds and other funds.
MOTION: Clements moved that the Council approve Pay Estimate No. 9 for Project No. PC-0901 & WC-1003 Dorchester Place and Camden Way project in the amount of $98,248.74 to Atlas Paving Co. Goetzinger seconded this motion.

14. Discussion, Consideration and Possible Action to award to the lowest and best bidder as recommended by the city engineer; for Project PC-1001, 2010-2011 GO Bond Paving and Drainage Wilshire Blvd.
MOTION: Geotzinger moved to award bid of Project PC-1001 to A-Tech Paving, as recommended by City Engineer Karl Baldischwiler. Clements seconded this motion.

15. Discussion, Consideration and Possible Approval or Other Actions in connection with the acquisition by the City of a well site, temporary and permanent easements for water lines and a water rights lease from People’s Church, Inc.
A. Discussion, Consideration and Possible Approval or Disapproval of acquisition from People’s Church, Inc., by warranty deed, of a tract of land located in Block 15, Adam’s Addition to Oklahoma City, Oklahoma, to be used for the construction of a new water well, together with temporary and permanent easements for a water line to be located in Blocks 15 and 16, Adam’s Addition to Oklahoma City, Oklahoma, at a total cost to the City of $28,500.00, subject to resolution of all outstanding issues, including required governmental approvals and title insurance requirements.
i. Discussion, Consideration and Possible Action to authorize the Mayor and city staff to execute all documents necessary to effectuate the foregoing.
MOTION: Clements moved authorize the Mayor and city staff to execute all documents necessary to effectuate agenda item 15A. Geotzinger seconded this motion.

Discussion, Consideration and Possible Approval or Disapproval of groundwater lease by People’s Church, Inc. for groundwater underlying approximately 50 acres of land located in Blocks 2, 7, 8, 10, 15 and 16, Adam’s Addition to Oklahoma City, Oklahoma, for the initial amount of $1,500.00 per year, subject to resolution of all outstanding issues, including required governmental approvals and title insurance requirements.
i. Discussion, Consideration and Possible Action to authorize the Mayor and city staff to execute all documents necessary to effectuate the foregoing.

16. Resolutions concerning the City’s Investment Policy to be given discussion, consideration and possible approval or disapproval:
A. Discussion, Consideration and Possible Approval of a Resolution amending the City’s Investment Policy to eliminate an exception from the minimum capital requirement for the City’s depository institutions, to limit the percentage of investable funds which may be placed in a single depository institution, to eliminate a requirement that depository institutions be chartered in the State of Oklahoma and to impose a requirement that depository institutions be headquartered in the State of Oklahoma.
MOTION: Clements moved to approve resolution 1189 eliminating an exception from the minimum capital requirement for the City’s depository institutions, limiting the percentage of investable funds placed in a single depository institution, eliminating a requirement that the depository institutions be chartered in the State of Oklahoma and to impose a requirement that depository institutions be headquartered in the State of Oklahoma. Geotzinger seconded this motion.

B. Discussion, Consideration and Possible Approval of a Resolution adopting a list of approved depository institutions for the City’s investment transactions.

17. Discussion, Consideration and Possible approval or disapproval to purchase the following capital improvement items:
A. Risk Manager is requesting to purchase of gym equipment, not to exceed $8,000; as approved in the FY 2012 – 2013 CIP budget.
B. Police Department is requesting to purchase four X2 Tasers and equipment, not to exceed $6,700. This is $700 over the amount approved in FY 2012-2013 CIP budget.
C. Public Works is requesting to purchase a Chevrolet half ton pickup truck, not to exceed $18,000; as approved in FY 2012-2013 CIP budget.
D. Public Works is requesting to purchase a new office work station, not to exceed $3,000; as approved in the FY 2012-2013 CIP budget.
E. Fire Department is requesting to purchase new beds and bedding, not to exceed $4,800; as approved in the FY 2012-2013 CIP budget.
