Minutes of the Board of Adjustments Meeting
August 17, 2011

1. Call to Order.

Mr. Tom Flesher called the meeting to order at 5:30 p.m.

2. Roll Call.

Acknowledgment was made by Mr. Flesher that he along with members Covington and Hall were all present. Chairman Clements and Vice-Chair Slater were absent.

Mr. Flesher welcomed new member Julie Hall to the Board of Adjustments for the City of Nichols Hills.  As a review for current board members and newly appointed board member  City Attorney John Michael Williams was requested to review the general powers and rules of the Board of Adjustment.

APPROVED Moved by Covington as modified during the meeting, seconded by Flesher.  AYES: Covington, Flesher and Hall NAYES:  None


4. PUBLIC HEARING Case No. 2011-04:  Discussion, Consideration, and Possible Action on Case 2011-04, for which the owners of 6436 NW Grand have requested a variance to build onto their home 12.5 feet past the rear setback.  Rear setback for this zone is 25 feet first floor.  Additionally, their request is for 12.5 feet past the front setback, which by ordinance is 25 feet.  This property is currently zoned R-1-60.

Mr. Jon  Horton spoke and answered questions on behalf of the homeowners.


APPROVED:  Covington Moved that application number 2011-04 be approved in accordance with submitted application as presented at this meeting because:
I. The application of the ordinance to this particular piece of property would create an unnecessary hardship:
II. Such conditions are peculiar to this particular piece of property;
III. The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and
IV. The variance is the minimum necessary to alleviate the unnecessary hardship.
seconded by Hall.  AYES: Covington, Flesher and Hall.

5. Adjournment.

Mr. Flesher adjourned the meeting.
