1. Call to Order.

Chairman Clements called the meeting to order at 5:30 p.m.

2. Roll Call.

Acknowledgment was made by Chairman Clements that he along with members Slater, Flesher and Covington were all present. Commission member Mahaffey was absent.

3. Minutes.  November 10, 2010

APPROVED Moved by Flesher, seconded by Covington.  AYES: Covington, Flesher, Clements, Slater NAYES:  None

4. PUBLIC HEARING:  Discussion, Consideration, and Possible Action on Case 2011-01, for which the owners of 1615 Pennington Way have requested a variance to build a garage past the rear setback line.  The setback is 25 feet because it is attached to the house.  The encroachment will be 3.89 feet up to 9.3 feet due to the shape of the lot.

Mr. Mike Bickford presented the proposal of this request to the Board of Adjustment Members.  Following the discussion Chairman Clements

APPROVED:  Slater  Moved that application number 2011-01 be approved in accordance with submitted application as presented at this meeting because:
I. The application of the ordinance to this particular piece of property would create an unnecessary hardship:
II. Such conditions are peculiar to this particular piece of property;
III. The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and
IV. The variance is the minimum necessary to alleviate the unnecessary hardship.
seconded by Flesher.  AYES: Clements, Flesher, Covington and Slater.

5. Adjournment.
