1. Call to Order

Chairman Clements called the meeting to order at 5:30 p.m. 

2. Roll Call

Acknowledgement was by Chairman Clements that he along with members Slater, Flesher and Covington were present; and member Mahaffey were absent.

3. Minutes:  Meeting – February 11, 2010

APPROVAL of minutes as modified and presented this evening moved by Flesher, seconded by Covington. AYES: AYES: Clements, Clements, Slater, Flesher, Covington

                 Meeting – July 21, 2010     

APPROVAL of minutes as modified and presented this evening moved by Slater, seconded by Flesher. AYES: AYES: Clements, Clements, Slater, Flesher, Covington

4. Public Hearing – Case No. 2010-04

Lot 7, Block 90, within the City of Nichols Hills, Oklahoma County, Oklahoma also known as 1715 Pennington Way. Current Zoning is R-1-75. The applicants are requesting a variance to erect a replacement fence 16 feet past the side yard setback.  The new fence will be in the same place as the old one

PUBLIC HEARING was opened.  Applicant and neighbor voiced their approval of this application. 

5. Discussion, Consideration and Possible Action on Case No. 2010 - 04, for which the owners of 1715 Pennington Way have requested a variance to erect a replacement fence 16 feet past the side yard setback.  The new fence will be in the same place as the old one.

APPROVED :  Moved that application number 2010-03 be approved in accordance with submitted application as presented at this meeting because:
I. The application of the ordinance to this particular piece of property would create an unnecessary hardship:
II. Such conditions are peculiar to this particular piece of property;
III. The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and
IV. The variance is the minimum necessary to alleviate the unnecessary hardship.
 Made by Covington, seconded by Slater.  AYES: Clements, Slater, Flesher, Covington.

6. Adjournment
