1.      Call to Order

Chairman Clements called the meeting to order at 5:30 p.m. 

2.      Roll Call

Acknowledgement was by Chairman Clements that he along with members Mahaffey, Flesher and Covington were present; and member Slater was absent. 

3.      Minutes:  Meeting – October 20, 2010

APPROVAL of minutes as modified and presented this evening moved by Flesher, seconded by Covington  AYES: Clements, Flesher, Covington, Mahaffey

4.      Public Hearing – Case No. 2010-06

Lot 1, Block 93 within the City of Nichols Hills, Oklahoma County, Oklahoma also known as 1900 Huntington. Current Zoning is R-1-60. The applicants are requesting a variance to build their home 5 feet past the side setback on the Pennsylvania Avenue side.  The setback is 15 feet for a corner lot on the side abutting the street.

5.      Discussion, Consideration and Possible Action on Case No. 2010 - 06, for which the owners of 1900 Huntington have requested a variance to build their home 5 feet past the side setback on the Pennsylvania Avenue side.  The setback is 15 feet for a corner lot on the side abutting the street.

APPROVED:  Moved that application number 2010-05 be approved in accordance with submitted application as presented at this meeting because:

                                 I.            The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                               II.            Such conditions are peculiar to this particular piece of property;

                              III.            The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

                           IV.            The variance is the minimum necessary to alleviate the unnecessary hardship.

 Made by Flesher, seconded by Covington.  AYES: Clements, Flesher, Covington and Mahaffey.  Mr. Mahaffey requested the minutes reflect his protest to the approval of this application, however he stated he decided to vote for this application to pass.
