MINUTES OF THE REGULAR MEETING OF THE NICHOLS HILLS PLANNING COMMISSION HELD TUESDAY, FEBRUARY 2ND, 2010 AT 5:30 P.M., TOWN HALL, MEMBERS PRESENT: Mike Bickford, Chairman Tim Cohn Larry Savage Clay Farha Jeff James John McCaleb MEMBERS ABSENT: OTHERS PRESENT: David Poole, City Manager Kristi Hort, City Clerk Wiley Rice, Planning Consultant Charles Hooper, Public Works Director The meeting was posted in accordance with the Open Meeting laws of the State of Chairman Bickford called the meeting to order and called the roll. Motion was made by McCaleb, seconded by Savage to approve the minutes of the regular meeting held January 5, 2010. Aye: Bickford, Savage, James, Cohn, Farha, McCaleb Nay: None Chairman Bickford requested the commission hold the work session on the agenda as Item 4d first. During the work session regarding the height & volume recommendations to the City council related to review of height and volume restrictions and other building and zoning restrictions in residential areas, included an update presented by Mr. Jay Yowell. He stated the student’s goal for the March meeting to include a detailed documentation and power point presentation. PUBLIC HEARING: A public hearing was held regarding the Amendment of Section 6-6 of the City code related to exterior lighting restrictions. Mr. Wiley Rice the latest draft ordinance for the consideration by this commission. No citizens requested to be heard regarding this item. Larry Savage made a motion to approve the ordinance amending Chapter 6 of the Nichols Hills Code regarding yard lights and prohibition of outdoor lights projecting onto other properties; where this ordinance shall not be applicable to lighting fixtures which exist on February 2, 2010; however all existing lighting fixtures moved, modified or replaced; repealing conflict ordinances or parts hereof, providing for severability, and declaring an emergency. This motion was seconded by John McCaleb. Aye: Savage, James, Cohn, Farha, McCaleb Nay: Bickford Item C the regarding the emergency section was cancelled. During the work session regarding the possible authorization of a temporary office building on construction site for Estate Lots. Commissioner McCaleb inquired if there is a restriction regarding the placement of a temporary office on an estate lot which is under construction. Public Works Director advised no there is not. Commissioners determined no additional discussion is necessary. There being no further business, the meeting was adjourned.
