Board of Adjustment


The board shall consist of five members, each to be appointed for a term of three years. There shall be one member of the board from each ward who shall be appointed by the councilman who represents the ward, with the approval of the city council. There shall also be two at large members of the board who shall be appointed by the mayor, with ​the approval of the city council.

The board of adjustment shall have the power to:

Hear and decide appeals if it is alleged there is error in any order, requirement, decision or determination made by an administrative official in the enforcement of the zoning codes. 

Authorize in specific cases a variance from the terms, standards, and criteria that pertain to an allowed use category within a zoning district when such cases are shown not to be contrary to the public interest if, owing to special conditions, a literal enforcement of the provisions of this chapter will result in unnecessary hardship and so that the spirit of the ordinance shall be observed and substantial justice done; 

Hear and decide oil and/or gas applications or appeals unless prohibited throughout the city by ordinance.





1. Preliminary set of Plans and Application for a building permit.

2. Department review of Preliminary Plans with comments by City Staff attached.

3. If the application is denied, then Step II of the appeal process may be initiated.


1. A letter of application must be submitted to the City Manager requesting a Public Hearing to appeal the action of the administrative officer and containing the following information:

  • Legal description of the property and the street address
  • Present zoning classification of the property
  • An explanation or nature of the variance or exception requested

2.  Nine complete sets of plans.

3.  A certified list of all property owners within a three hundred foot (300') radius of the exterior boundary of the property.

4.  A $200.00 filing fee. 

Prior to a Board of Adjustment meeting, it is improper to send written comments, emails, conventional mail, or faxes to; or correspond directly with a Board of Adjustment member concerning an agenda item.


Any one wanting to be heard on an agenda item can submit written comments or correspondence to the Board of Adjustment by submitting these comments or correspondence to the City Clerk prior to the start of the meeting.


During the meeting, all comments and correspondence received by the City Clerk will be presented to board members and a copy of the comments or correspondence will be entered into the official meeting record.
