Minutes of the Board of Adjustments Meeting

June 19, 2013

 

Original Agenda Filed in the Office of the Municipal Clerk at 2:30 PM on the 14th day of June, 2013.

1.      Call to Order.

 

Vice-Chairman Flesher called the meeting to order at 5:30 p.m.

 

2.      Roll Call.

 

Acknowledgment was made that Vice-Chairman Flesher, Members Hall and Covington were present.  Chairman Slater and Mr. Clements were absent. 

 

3.      Nomination of Chairman and Vice-Chairman

 

Commission members delay action until the end of the meeting, pending attendance of other members.

 

Hall Moved to nominate Robert Slater as Chairman, and Tom Flesher as Vice-Chairman.  Covington seconded the motion.

AYES: Flesher, Hall and Covington

NAYS: None

 

4.      Minutes.

 

a.      None

 

 

5.      PUBLIC HEARING Case No. BOA 2013-02:   Discussion, consideration and possible action on Case BOA 2013-02, for which the owners of 1707 Coventry have requested a variance to add 372 square feet to the back of their single story home. This will be in violation of the side setback by (43) four feet three inches. This property is currently zoned R-1-75.

 

A representative for the property owner spoke to board members, followed by discussion among board members.  The public hearing was opened, having no one express a desire to be heard, the public hearing was closed.

 

 

APPROVED:  Hall Moved that application number 2013-02 be approved in accordance with submitted application as presented at this meeting because:

                           I.         The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                         II.         Such conditions are peculiar to this particular piece of property;

                        III.         The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

The variance is the minimum necessary to alleviate the unnecessary hardship. Seconded by Covington.

AYES: Flesher, Hall and Covington

NAYS: None

 

6.      PUBLIC HEARING Case No. BOA 2013-03:  Discussion, consideration and possible action n Case BOA 2013-03, for which the owners of 6507 N. Lenox have requested a variance to add onto their single story home.  This will be in violation of the side setback by (13) one foot three inches.

 

A representative for the property owner spoke to board members, followed by discussion among board members.  The public hearing was opened, having no one express a desire to be heard, the public hearing was closed

 

APPROVED:  Covington Moved that application number 2013-03 be approved in accordance with submitted application as presented at this meeting because:

                                 I.   The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                         II.         Such conditions are peculiar to this particular piece of property;

                        III.         The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

                      IV.         The variance is the minimum necessary to alleviate the unnecessary hardship. Seconded by Hall. 

AYES: Flesher, Hall and Covington

NAYS: None

 

At this time, board members returned to agenda item 3.

 

7.      Adjournment.   There being no further business, Vice-Chairman Flesher adjourned the meeting
