Minutes of Regular City Council Meeting

May 14, 2013

1.   Call to Order.  Mayor Hoffman called the meeting to order and declared a quorum present to conduct business.   

 

2.   Roll Call.  A roll call reflected that Mayor Hoffman, Vice-Mayor Goetzinger and councilmember Clements were present. 

 

 

a)      Oath of office for newly elected Councilman E. Peter Hoffman, Jr.  to be administered by Honorable Judge Charles Lutz.

 

Judge Charles Lutz administered the Constitutional and Loyalty Oaths of office to newly elected councilmember E. Peter Hoffman, Jr.

 

b)      Nomination and election of Mayor of City of Nichols Hills.

 

Councilmember Clements nominated Steven J Geotzinger as Mayor, followed by a motion to elect Steven J Geotzinger as Mayor of the City of Nichols Hills.  Seconded by Hoffman.

AYES: Clements Hoffman, Goetzinger

NAYS:  None 

 

c)      Nomination and election of Vice-Mayor of the City of Nichols Hills.

 

Councilmember Hoffman nominated Sody Clements as Vice-Mayor, followed by a motion to elect Sody Clements as Vice-Mayor of the City of Nichols Hills.  Seconded by Goetzinger.

AYES: Hoffman, Goetzinger, Clements

NAYS:  None

 Hoffman moved that the Council approve the total warrants and claims as presented.  Clements seconded this motion.

6.      Citizens desiring to be heard.  Ms. Helen Southerland addressed council to request no parking on the south side of the 1900 block of Elmhurst.

 

7.      Discussion consideration and possible approval or disapproval of Amendment No. 3, in the amount of $<12,877.59>, for Project No.  PC-0901 & WC-1003 for the Dorchester Place and Camden Way paving improvements.  This decreases the original contract amount to $1,307,733.85, to be paid out of the 2008-2009 GO Bonds and other funds.

 

 Clements  moved approval of item 7, seconded by Hoffman.

8.      Discussion, consideration and possible action authorizing Pooch Parade to install 20 banners  on Grand Boulevard between NW 63rd and Pennsylvania within the City of Nichols Hills between September 13, 2013 to September 24, 2013.

 

 Hoffman moved approval of item 8, seconded by Clements.

9.      Discussion, consideration and possible action authorizing Nichols Hills Garden Tour to install 20 banners throughout Nichols Hills.  The Garden Tour is scheduled for June 1, 2013 with a rain date of June 2, 2013.

10.  Discussion, consideration and possible approval or disapproval of acceptance of the following permanent easements:

 

a)      from David R. Harlow and Aimee R. Harlow for property situated in Oklahoma County, Oklahoma, to wit:

                                                   i.      The East Ten (10) feet of Lot Six (6), Block Thirty-three (33), Nichols Hills Addition according to the plat thereof recorded in Book 22 of Plats at Page 44 in the records of the Oklahoma County Clerk, said easement lying adjacent to and measured 10’ perpendicular to the east line of said Lot 6 which is common with the west line of Lots 2 and 3 of said Block 33

 

b)      from Alison Evans Taylor for property situated in Oklahoma County, Oklahoma, to wit:

                                                   i.      The East Ten (10) feet of Lot Five (5), Block Thirty-three (33), Nichols Hills Addition according to the plat thereof recorded in Book 22 of Plats at Page 44 in the records of the Oklahoma County Clerk, said easement lying adjacent to and measured 10’ perpendicular to the east line of said Lot 5 which is common with the west line of Lots 3 and 4 of said Block 33

 

c)      from Linda G. Alexander, Trustee of the Linda G. Alexander Revocable Trust, dated August 27, 1998 for property situated in Oklahoma County, Oklahoma, to wit:

                                                               i.      The East Ten (10) feet of Lot Seven (7), Block Thirty-three (33), Nichols Hills Addition according to the plat thereof recorded in Book 22 of Plats at Page 44 in the records of the Oklahoma County Clerk, said easement lying adjacent to and measured 10’ perpendicular to the east line of said Lot 7 which is common with the west line of Lots 2 of said Block 3.

11.  Discussion, consideration and possible approval or disapproval of:

 

a)      Final Pay Estimate No. 12, for Project No. PC-0901 & WC-1003, Dorchester Place and Camden Way in the amount of $10,337.25 to Atlas Paving Co. To be paid out of the 2008-2009 GO Bonds and other funds.

 

b)      Pay Estimate No. 6 for Project No. PC-1001, Wilshire Boulevard in the amount of $189,060.35 to A-Tech Paving.  To be paid out of 2010-2011 GO Bonds and other funds.

 

c)      Pay Estimate No. 2 for Project No. PC-1101, Grand Boulevard in the amount of $121,858.24 to SAC Services.  To be paid out of 2010-2011 GO Bonds and other funds.

 

d)      Final Pay Estimate for Emergency Sanitary Sewer Rehabilitation in the amount of $ 69,500 to Urban Contractors, LLC.  To be paid out of 2009 GO Bonds and other funds.

12.  Discussion, consideration and possible approval or disapproval to add additional insulation for the attic space over the Fire Station not to exceed $1,000, as approved in FY 2012-2013 CIP budget.

13.  Discussion, consideration and possible action to review, approve, ratify and accept contract and bonds, which may include construction, maintenance and performance bonds, relating to Project WC-0113 for the 2011 Bond Well Collection Replacement project.

14.  Discussion, consideration and possible action to review, approve, ratify and accept contract and bonds, which may include construction, maintenance and performance bonds, relating to Project WC-1001, also referred to as Project WW-1001, for the 2010 Bond New Water Wells No. 15 & 16 project.

16.  Discussion, consideration and possible approval or disapproval concerning the agreement between City of Nichols Hills and Oklahoma Zoological Trust regarding Remington Park.

17.  Discussion, consideration and possible action regarding time limits for building and remodeling homes.

 

Hoffman moved to suggest this is along the right path and commend everybody on their hard work and excellent and would like to encourage you to continue to put it into form.   Seconded by Clements

18.  Discussion, consideration and possible action concerning parking motor homes and trailers in Nichols Hills.

 

Clements moved to proceed on this outstanding ordinance for the off street parking regulations. Seconded by Hoffman.

19.  Discussion, consideration and possible action concerning uses permitted on review regarding fences.

 

Hoffman moved to direct City Attorney to prepare a different ordinance that eliminates a Use Permitted on Review for fences in the E districts. Seconded by Clements.

            NAY: None

 

20.  Discussion, consideration and possible action regarding front yard setbacks for new houses.

 

Following council discussion, no action was taken.

 

 

21.  Adjournment. There being no further business Hoffman made a motion to adjourn this meeting, which was seconded by Clements, which was unanimously approved.
