March 12, 2013

1.   Call to Order.  Mayor Hoffman called the meeting to order and declared a quorum present to conduct business.   

 

2.   Roll Call.  A roll call reflected that Mayor Hoffman, Vice-Mayor Goetzinger and councilmember Clements were present. 

 

3.      Consent Calendar:

4.      Minutes:  February 12, 2013

 

 Clements moved to approve the February 12, 2013 minutes as presented. Goetzinger seconded this motion.

 Goetzinger moved that the Council approve the total warrants and claims as presented.  Clements seconded this motion.

6.      Citizens desiring to be heard.  No one expressed a desire to be heard.

 

7.      Discussion, consideration and possible approval of proclamation declaring the week of March 25, 2013 through March 29, 2013 as Arbor Week in the City of Nichols Hills.

 

Mayor Hoffman announced the proclamation claiming Arbor week in Nichols Hills. Clements moved approval of item 7, seconded by Goetzinger.

8.      Discussion, consideration and possible action to award Project HVAC 2013 for the Renovation and Repair of Heating Ventilation and Air Conditioning System to the lowest and best bidder as recommended by the Wynn Engineering; and, to review, approve, ratify and accept related bonds, which may include construction, maintenance and performance bonds.

 

Goetzinger moved the project documented in item 8 be awarded to Harrison-Orr and acceptance of all bonds noted, seconded by Clements.

 

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

9.      Discussion, consideration and possible approval or disapproval of request from Planet Nichols Hills to display banners at the First Church of Christ Science site; and close a portion of Sherwood from Grand Boulevard to the entrance into the church facility.

 

Clements moved approval of item 9 and striking everything following the semicolon; subject to and furtherance of the material contained in the letter provided by Nancy Herzel, excluding the final two paragraphs. Seconded by Goetzinger.

10.  Discussion, Consideration and Possible Approval of a Resolution adopting an amended list of approved depository institutions for the City’s investment transactions.

 

Nichols Hills City Treasurer provided a summary of events resulting in the request to amend the list of approved depository institutions. Clements moved adoption of the resolution for item 10, seconded by Goetzinger.

11.  Discussion, consideration and possible action concerning a monthly movie night at Kite Park.

 

Ms. Beth Pitman addressed council with the idea of displaying G rated movies in the park. The movies would be shown between 8:30 and 10 PM.  She advised the movies would be displayed on a large inflatable screen.  Council members discussed the recently adopted ordinance prohibiting inflatables in the parks, due to damages to sprinkler systems.  Ms. Pitman will review options for eliminating an inflatable screen with spikes.  These events would be funded via donations from residents, with all garbage collected and removed the evening of the event.  Goetzinger moved approval of item 11 subject to not using spikes with the inflatable screen, seconded by Clements.

12.  Discussion, consideration and possible action on recommendation from Environmental Health and Sustainability Commission to require freeze and rain sensors on new and repaired irrigation systems and implement a permit fee.

 

Following the recommendation from Nancy Herzel, EHS chairman to require freeze and rain sensors for irrigation systems.  Council member Goetzinger moved to direct staff to draft ordinance requiring sensors on new water sprinklers systems, to further develop a plan and ordinance as necessary to deal with existing situations where sprinkler systems are wasting water and causing safety concerns perhaps by way of nuisance or any other way of appropriate method. The motion was seconded by Hoffman.

13.  Discussion, consideration and possible approval or disapproval to enter into an Interlocal Cooperative Agreement with the City of Oklahoma City and the City of Nichols Hills for accessible pedestrian signals and ADA curb ramps at the following location: vicinity of NW 63rd Street and Pennsylvania Avenue.

 

Clements moved approval of item 13, seconded by Goetzinger.

14.  Discussion, consideration and possible approval or disapproval of Pay Estimate No. 4 for Project No. PC-1001, Wilshire Boulevard Paving Improvements in the amount of $261,597.30 to A-Tech Paving. To be paid out of the 2010-2011 GO Bonds and other funds.

 

Goetzinger moved approval of item 14, seconded by Clements.

15.  Discussion, consideration and possible approval or disapproval to purchase computer equipment not to exceed $13,300, as approved in FY 2012-2013 CIP budget.

 

Clements moved approval of item 15, seconded by Goetzinger.

            NAY: None

 

16.  Discussion, consideration and possible approval or disapproval to purchase a new 2013 Ford Police Interceptor not to exceed $35,000, as approved in FY 2012-2013 CIP budget.

 

Goetzinger moved approval of item 16, seconded by Clements.

17.  Discussion, consideration and possible approval or disapproval to surplus a 2010 Police Interceptor (VIN# 2FABP7BV1AX110926); and approval to trade vehicle in on purchase of new police vehicle.

 

Clements moved approval of item 17, seconded by Goetzinger.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

18.  Discussion, consideration and possible approval or disapproval to purchase replacement windows for the south wall of the fire station, not to exceed $2,500, as approved in FY 2012-2013 CIP budget.

 

 

Goetzinger moved approval of item 18, seconded by Clements.

            NAY: None

 

 

 

 

19.  Discussion, Consideration and Possible Action regarding a resolution authorizing the sale of $4,000,000 of General Obligation Bonds, Series 2013 of the City of Nichols Hills, Oklahoma; fixing the amount of bonds to mature each year; fixing the manner, time and place the bonds are to be sold; authorizing the City Clerk to give notice of said sale as required by law and to publish notice of sale; approving and authorizing official statements, amending, extending, ratifying and approving a bond counsel contract and a financial services contract with respect to the bonds, and providing for other aspects of the bonds and issuance of the bonds; and declaring an emergency.

 

Clements moved approval of item 19, seconded by Goetzinger.

a)      Consider, discuss and approve or disapprove an Emergency Section for the foregoing Resolution.

 

 

Goetzinger moved approval of the emergency section of item 19a, seconded by Clements.

20.  Discussion, consideration and possible action regarding front yard setbacks for new houses.

 

Following council members discussion of the issue of front yard setbacks, Clements moved to direct staff to research this issue and bring back to City Council prior to referring to the Planning Commission, seconded by Goetzinger.

            AYE:  Hoffman, Goetzinger, Clements

                        NAY: None

 

21.  Discussion, consideration and possible action concerning parking motor homes and trailers in Nichols Hills.

 

Clements moved to direct staff to craft an ordinance to prohibit view of any trailers, motor homes, etc from a public street or other residence; and allow a temporary time frame allowing for loading and unloading.  The motion was seconded by Goetzinger.

                        NAY: None

 

22.  Discussion, consideration and possible action concerning time limits for building and remodeling homes in Nichols Hills.

 

Goetzinger moved to refer this issue to the Planning Commission for consideration, seconded by Clements.

                        NAY: None

 

 

23.  Discussion, consideration and possible approval or disapproval of Pick up the Pace Kids Fun Run.

 

Goetzinger moved approval of item 23 as supplemented by the last paragraph of the letter provided by Nancy Herzel with route to be subject to Nichols Hills Police Chief approval.  The motion was seconded by Clements.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

 

24.  Adjournment. There being no further business Goetzinger made a motion to adjourn this meeting, which was seconded by Clements, which was unanimously approved.
