February 12, 2013

1.   Call to Order.  Mayor Hoffman called the meeting to order and declared a quorum present to conduct business.   

 

2.   Roll Call.  A roll call reflected that Mayor Hoffman, Vice-Mayor Goetzinger and councilmember Clements were present. 

 

3.      Consent Calendar:

MOTION:  Goetzinger moved to approve the consent calendar as presented.  Clements seconded this motion.

4.      Minutes:  January 8, 2013

 MOTION:  Goetzinger moved to approve the January 8, 2013 minutes as presented.  Clements seconded this motion.

MOTION:  Clements moved that the Council approve the total warrants and claims as presented.  Goetzinger seconded this motion.

6.      Citizens desiring to be heard.  No one expressed a desire to be heard.

 

7.      PUBLIC HEARING: Discussion, Consideration and Possible Approval or disapproval on Case PC 2013-01 for which the owners of 6707 NW Grand Boulevard are requesting to erect a fence higher than allowed by code.  This property is currently zoned E-2.

 

 Clements moved approval of item 7, seconded by Goetzinger.

            NAY: None

 

8.      Discussion, Consideration and possible approval or disapproval of a Resolution to execute that certain Project Agreement for Federal-aid Project Number STP-155D(899)AG, State Job Number 28693(04) regarding a pedestrian trail along Grand Blvd.

 

Motion was made by Goetzinger to move item 8, the motion was seconded by Clements.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

9.      Discussion, Consideration and possible approval or disapproval of Pay Estimate No. 3 for Project No. PC-1001, Wilshire Boulevard Paving Improvements in the amount of $310,146.75 to A-Tech Paving. To be paid out of the 2010-2011 GO Bonds and other funds.

 

Clements moved approval of item 9, seconded by Goetzinger.

            NAY: None

 

10.  Discussion, Consideration and possible approval or disapproval of request from Pi Beta Phi Alumnae Club to hang approximately 20 banners in all four directions of the intersection of Grand Boulevard and Pennsylvania Avenue.  Banners will be in place February 14 through 27, 2013.

 

Goetzinger moved approval of item 10, seconded by Clements.

11.  Discussion, Consideration and possible approval or disapproval of request from Oklahoma City Memorial Marathon requesting to hang banners within the Nichols Hills City Limits between April 1, 2013 and April 30, 2013 for the Oklahoma City Memorial Marathon event.

 

Clements moved approval of item 11 authorizing banners to be displayed between April 15, 2013 and April 30, 2013, and subject to a bond in the amount determined by the City of Nichols Hills Finance Director, seconded by Goetzinger.

12.  Discussion, Consideration and Possible approval or disapproval concerning possible Utility Billing Refund to Mr. James VanStone.

 

Goetzinger moved approval of item 12, seconded by Clements.

13.  Discussion, Consideration and possible action on recommendation from Environmental Health and Sustainability Commission to require freeze and rain sensors on new and repaired irrigation systems and implement a permit fee.

 

 Goetzinger moved to table item 13, seconded by Clements.

            NAY: None

 

14.  Discussion, consideration and possible action to review, approve, ratify and accept bonds related to Project PC-1101 for the 2011-2012 GO Bond paving improvements on Grand Boulevard Phase I, which may include construction, maintenance and performance bonds.

 

Clements moved approval of item 14, seconded by Goetzinger.

            NAY: None

 

15.  Discussion, consideration and possible action to review, approve, ratify and accept bonds related to the Plat of Glenbrook Park in Nichols Hills, which may include construction, maintenance and performance bonds.

 

Goetzinger moved approval of item 15, seconded by Clements.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

16.  Discussion, Consideration and possible approval or disapproval to solicit bids to purchase a street sealer for Public Works.  Cost will not exceed $55,000, and was approved in the FY 2012-2013 CIP budget.

 

Clements moved approval of item 16, seconded by Goetzinger.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

17.  Discussion, Consideration and possible approval or disapproval to purchase a new administrative vehicle to replace Unit 34.  Cost will not exceed $37,000, and was approved in the FY 2012-2013 CIP budget.

 

Goetzinger moved approval of item 17, seconded by Clements.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

18.  PUBLIC HEARING:  Discussion, Consideration and Possible Approval or Disapproval of amendments to the Nichols Hills Code regarding building setbacks on corner lots.

 

City Attorney John Williams recommended this item be tabled.  Clements moved to table item 18, seconded by Goetzinger.

            AYE:  Hoffman, Goetzinger, Clements

            NAY: None

 

19.  Discussion, Consideration and Possible Action to direct staff to prepare a draft ordinance regarding uses permitted on review with draft ordinance to be referred to Planning Commission for recommendation.

 

Goetzinger moved approval of item 19 subject to the limitation of fencing, seconded by Clements.

            AYE:  Hoffman, Goetzinger, Clements

                        NAY: None

 

20.  Adjournment. There being no further business Clements made a motion to adjourn this meeting, which was seconded by Goetzinger, which was unanimously approved.
