Minutes of the Board of Adjustments Meeting

July 18, 2012

1.      Call to Order.


Chairman Slater called the meeting to order at 5:30 p.m.


2.      Roll Call.


Acknowledgment was made by Chairman Slater he along with members Flesher, Covington, Clements and Hall were all present.


3.      Election of officers


No Action



4.      Minutes.

APPROVED Moved by Flesher, seconded by Covington. 



AYES: Flesher, Clements, Slater, Hall and Covington. 

NAYS:  None




5.      PUBLIC HEARING Case No. 2012-06:   Discussion, consideration and possible action on Case 2012-06, for which the owners of 6500 Lenox have requested a variance to build a new home that will extend 8 feet past the rear yard setback. This property is currently zoned R-1-75.


Mr. Rob Garbecht spoke to commission members on behalf of the applicant of this variance, followed by Chairman Slater opening the public hearing.  Residents shared their support and opposition for this variance request.  Chairman Slater closed the public hearing.



Following commission members discussion of this request, the following motion was made.


APPROVED:  Clements moved that application number 2012-06 be approved in accordance with submitted application as presented at this meeting because:

                           I.         The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                         II.         Such conditions are peculiar to this particular piece of property;

                        III.         The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

                      IV.         The variance is the minimum necessary to alleviate the unnecessary hardship. Subject to the property owner granting the City of Nichols Hills a five foot easement to accommodate the sewer line, seconded by  Hall . 


AYES: Flesher, Clements, Hall and Covington. 

NAYS:  Slater  




6.      Adjournment.  There being no further business Chairman Slater adjourned the meeting.
