Minutes of the Planning Commission Meeting

October 2, 2012

1.      Call to Order.

 

Chairman Bickford called the meeting to order.

 

2.      Roll Call.

 

Acknowledgment was made by Chairman Bickford that all commission members were present. 

 

3.      Citizens desiring to be heard:  None

 

4.      Minutes:    September 4, 2012

 

APPROVED:  A motion was moved by McCaleb, to approve the revised version of the minutes, seconded by Savage. 

AYES: Bickford, Gilbert, McCaleb, Cohn and Savage.

NAYES:  None

ABSTAIN: Pringle

 

5.      PUBLIC HEARING: Discussion, Consideration and Possible action recommending the amendment of Section 25-52.020 of the Nichols Hills City Code adding and removing definitions; amending section 25-52.030 of the Nichols Hills City Code relating to special use permits; adding a new subsection to section 25-52.030 of the Nichols Hills City Code to regulate placement of distributed antenna systems; amending section 25-52.040 of the Nichols Hills City Code removing certain antenna structures available without special use permits.

 

Chairman Bickford opened the public hearing for this agenda item.  Seeing that no one present expressed a desire to speak, the public hearing was closed.  Following discussion by the commission members, a Motion to recommend approval of this ordinance to city council was made by McCaleb  and seconded by Pringle.  

AYES: Bickford, Gilbert, Pringle, McCaleb, Cohn and Savage.

NAYES:  None.

 

6.      PUBLIC HEARING Discussion, Consideration and Possible Approval or Disapproval of amendments to the Nichols Hills Code regarding front yard setback requirements for combined lots.

 

Chairman Bickford opened the public hearing for this agenda item.  One resident questioned why the backyard fence requirements for combined lots must maintain the same requirements of the neighbors’ front yard fence.  Seeing that no others desired to speak, the public hearing was closed.

 

Following discussion by the commission members, Chairman Bickford requested the following amendments to the proposed ordinance be read into the record: “adjacent” will be changed to “abutting” in two locations; the word such will be added as follows: within “such” front yard; and you are entitled to “one front yard”.

 

Motion to recommend adoption of amended ordinance as read into the record, was moved by Savage and seconded by McCaleb.  

 

AYES: Bickford, Gilbert, McCaleb, Pringle, Cohn and Savage.

NAYES:  None.

 

7.      PUBLIC HEARING:  Discussion, Consideration and Possible Approval or Disapproval of amendments to the Nichols Hills Code regarding building setbacks on corner lots.

 

Motion to continue this public hearing to the regular scheduled meeting on Monday November 5, 2012 at 5:30 p.m., was made by Savage and seconded by Pringle.  

 

AYES: Bickford, Gilbert, McCaleb, Pringle, Cohn and Savage.

NAYES:  None.

 

8.      Adjournment

 

There being no further business, McCaleb made a MOTION to adjourn the meeting, seconded by Pringle. 

 

AYES: Bickford, Gilbert, McCaleb, Pringle, Cohn and Savage.
