Minutes of the Board of Adjustments Meeting

April 18, 2012

1.      Call to Order.

 

Chairman Clements called the meeting to order at 5:30 p.m.

 

 

 

2.      Roll Call.

 

Acknowledgment was made by Chairman Clements he along with members Slater, Flesher, Covington and Hall were all present.

 

 

3.      Election of Officers

 

 

Motion was made by Clements to election Slater as chairman of the Board of Adjustment, seconded by Hall. AYES: Covington, Flesher, Clements, Slater and Hall NAYS: None

 

 

Motion was made by Clements to election Flesher as vice-chairman of the Board of Adjustment, seconded by Hall. AYES: Covington, Flesher, Clements, Slater and Hall NAYS: None

 

 

 

4.      Minutes.

 

a.      March 21, 2012

 

APPROVED Moved by Covington, seconded by Flesher.  AYES: Covington, Flesher, Clements, Slater and Hall NAYS: None

 

 

 

 

 

 

5.      PUBLIC HEARING Case No. 2012-03:   Discussion, Consideration, and Possible Action on Case 2012-03, for which the owners of 6603 Trenton have requested a variance to build onto their home 4 feet past the side setback.  This property is currently zoned R-1-60.

 

 

 

DISAPPROVED:   Slater  moved application number 2012-03 be disapproved; seconded by Flesher.   Property owner addressed board members with more information.  Following length discussion Slater withdrew motion to disapprove.

 

 

APPROVED:  Hall  Moved that application number 2012-03 be approved in accordance with submitted application as presented at this meeting because:

                                 I.            The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                               II.            Such conditions are peculiar to this particular piece of property;

                              III.            The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

                            IV.            The variance is the minimum necessary to alleviate the unnecessary hardship.

seconded by Covington.  AYES: Slater, Flesher, Clements, Hall and Covington.  NAYS:  None   ABSTAIN: None

 

 

 

6.      PUBLIC HEARING Case No. 2012-05:   Discussion, Consideration, and Possible Action on Case 2012-05, for which the owners of 6608 Avondale have requested a variance to build onto their home 26 past the side setback on South side of the lot, 2 on the north side of the lot, as well as 43 past the front yard setback.  This property is currently zoned R-1-60.

 

 

 

DISAPPROVED:   Slater  moved application number 2012-05 be disapproved the front yard setback variance request; seconded by Hall.  AYES: Covington, Flesher, Clements, Slater and Hall. NAYS:  None ABSTAIN: None

 

APPROVED:   Covington  Moved that application number 2012-05 be approved the 26 South side yard setback and 2 North side yard setback variance request in accordance with submitted application as presented at this meeting because:

                                 I.            The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                               II.            Such conditions are peculiar to this particular piece of property;

                              III.            The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and
