Minutes of the Board of Adjustments Meeting

September 21, 2011

1.      Call to Order.

 

     Chairman Clements called the meeting to order at

      5:30 p.m.

 

2.      Roll Call.

 

Acknowledgment was made by Chairman Clements he along with members Slater, Flesher, Covington and Hall were all present.

 

3.      Minutes.

APPROVED Moved by Covington as modified during the meeting, seconded by Hall.  AYES: Covington, Flesher, Clements, Slater and Hall  NAYS: None

 

 

4.      PUBLIC HEARING Case No. 2011-05:   Discussion, Consideration, and Possible Action on Case 2011-05, for which the owners of 1605 Dorchester Drive have requested a variance to build onto their home 12.5 feet past the rear setback.  Rear setback for this zone is 25 feet first floor.  This property is currently zoned R-1-75.

 

APPROVED:  Slater Moved that application number 2011-05 be approved in accordance with submitted application as presented at this meeting because:

                                 I.            The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                               II.            Such conditions are peculiar to this particular piece of property;

                              III.            The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

                            IV.            The variance is the minimum necessary to alleviate the unnecessary hardship.

seconded by Flesher.  AYES: Slater, Flesher and Hall. NAYS:  Covington and Clements,

 

5.      PUBLIC HEARING Case 2011-06:   Discussion, Consideration, and Possible Action on Case 2011-06, for which the owners of 1122 Huntington Drive have requested a variance to build onto their home 1.5 feet past the side yard setback.  This property is currently zoned R-1-60

 

APPROVED:  Hall Moved that application number 2011-06 be approved in accordance with submitted application as presented at this meeting because:

                                 I.            The application of the ordinance to this particular piece of property would create an unnecessary hardship:

                               II.            Such conditions are peculiar to this particular piece of property;

                              III.            The granting of this variance will not cause substantial detriment to the public good, or impair the purposes and intent of the ordinance or the comprehensive plan; and

                            IV.            The variance is the minimum necessary to alleviate the unnecessary hardship.

seconded by Covington.  AYES: Covington, Flesher, Clements, Slater and Hall

 

6.      Discussion, Consideration and Possible Action to approve the 2012 schedule of regular meeting dates for Nichols Hills Board of Adjustments.

 

APPROVED Moved by Clements as modified during the meeting, seconded by Flesher.  AYES: Covington, Flesher, Clements, Slater and Hall  NAYS: None

 

 

7.      Adjournment.
