Minutes of the Planning Commission Meeting

October 4, 2011

1.      Call to Order.


Chairman Bickford called the meeting to order.


2.      Roll Call.


Acknowledgment was made by Chairman Bickford that he along with Commission members Gilbert, Savage, Cohn and McCaleb were present.  He also advised that Mr. Jeff James has resigned from this commission.

APPROVED:  MOTION was moved by McCaleb, seconded by Gilbert.  AYES: Bickford, Gilbert, McCaleb, Cohn and Savage. NAYES:  None



5.      PUBLIC HEARING:  Consider and approve or disapprove the application seeking a special permit application, submitted by T-Mobile Central LLC (T-Mobile) for the tower located at 6706 N Pennsylvania Avenue, Nichols Hills, Oklahoma.  T-Mobile currently has 6 antennas mounted on a steel monopole tower on City property.  This monopole is also mounted with a tornado siren.  T-Mobile seeks a special use permit to upgrade the wireless communication service from 2G to 3G technology.  The changes will also improve the appearance of the tower.


The public hearing was opened and Commissioner Gilbert recused herself from this agenda item.  Chairman Bickford advised a quorum remains to vote on this item and we will proceed with the public hearing.


Mr. Tom Ladner spoke on behalf of T-Mobile.  He provided pictures of the current equipment toward the top the monopole and a sample picture of the replacement equipment. He advised the replacement equipment will reduce the number of antennas and be flush mounted. The discussion included the continuation of the City of Nichols Hills storm siren atop the pole.


Ms. Brown, 6622 Hillcrest, spoke to the commission.  She provided her historical recollection of the events of this tower including her opposition of this tower.


APPROVED:  MOTION to APPROVE was moved by McCaleb, seconded by Savage.  AYES: Bickford, Cohn, McCaleb and Savage. NAYES:  None  RESCUSED:  Gilbert



6.      Work Session:  Work session regarding corner lots, with possible action as desired by the Planning Commission.


City Attorney John Michael Williams provided a background paper to aide commission discussion during this work session.  Mr. Jay Yowell presented a power point presentation of some corner lots within our city limits.  His presentation including some random comparisons of building lines versus platted lines. 


Mr. Mac Kilpatrick, Ms. Nancy Herzel, Ms. Beverly Perri and Ms. Judy Federa addressed the commission stating their concerns regarding corner lots. 


Following lengthy discussion among staff, city attorney, Mr. Wiley Rice residents and members of the planning commission, McCaleb made a MOTION to hold a work session at the November 1, 2011 Planning Commission meeting regarding enforcement of platted building lines along street frontages to include corner lots seconded by Gilbert.  AYES: Bickford, Gilbert, McCaleb and Cohn. NAYES:  None  {During the discussion portion of this item Mr. Savage left the meeting for another meeting.}
