1. Call to Order.

Vice-Mayor Clements called the meeting to order at 5:30 p.m.; then led the flag salute.

Acknowledgment was made by Vice-Mayor Clements that she and Councilmember Hoffman were all present.  Mayor Lippert was absent

Vice-Mayor Clements presented a certificate of recognition of 25 years of municipal government service to these three Nichols Hills employees.  On behalf of the Nichols Hills City Council, she expressed appreciation of dedication and hard work of these exemplary employees.


8. PUBLIC HEARING:   1601 NW 63rd Street PUD Application. Discussion, Consideration and Possible Action on the application filed by Blackstone Commercial Property Advisors, L.C. to rezone 1601 NW 63rd Street, Nichols Hills, Oklahoma, from the “E-1” Estate District to “PUD” Planned Unit Development District and to adopt a “PUD” Planned Unit Development District and a “PUD” Planned Unit Development Master Development Plan entitled the Enclave at Glenbrook Terrace, for residential use.

Continued until 5:30 p.m. Tuesday December 14, 2010. Moved by Hoffman, seconded by Clements.  AYES. Clements, Hoffman NAYS: None  


9. PUBLIC HEARING.  Discussion, Consideration and Possible Action regarding an ordinance amending Section 25-5 of the Nichols Hills City Code and the official Zoning District Map to include additional territory with the “PUD” Planned Unit Development District and adopting and approving the Planned Unit Development of 1912 Guilford Lane Christ the King School PUD (PUD-3); repealing all ordinances or parts of ordinances in conflict; providing for severability; and declaring an emergency.

10. General Obligation Bonds, Series 2011

a. Discussion, Consideration and Possible Action to ratify and approve Registrar, Transfer Agent and Paying Agent Agreement regarding general obligation bonds with Bank of Oklahoma, N.A.

b. Receive bids for sale of $5,400,000 General Obligation Bonds, Series, 2011, and award sale of bonds to the bidder bidding the lowest interest cost.

c. Discussion, Consideration and Possible Action regarding an ordinance providing for the issuance of General Obligation Bonds in the sum of Five Million Four Hundred Thousand Dollars ($5,400,000) by the City of Nichols Hills, Oklahoma, authorized at elections duly called and held for such purpose; prescribing form of bonds; providing for a combined bond issue designated “General Obligation Bonds, Series 2011”; prescribing redemption provisions; designating bonds for purposes of certain provisions of the Internal Revenue Code; providing for registration thereof; appointing a paying-agent registrar for the issue and waiving competitive selection thereof; approving the Official Statement pertaining to the bonds; providing for the levy of an annual tax for payment of principal and interest on the bonds; authorizing the approval of a continuing disclosure agreement and other contracts and instruments necessary to consummate sale of the bonds and disbursement of proceeds of the bonds; fixing other details of the bond sale and issuance; and declaring an emergency.

11. Discussion, Consideration and Possible Action to approve Pay Estimate No. 6 on Project No. SC-0901 to Jordan Contractors, Inc. in the amount of $96,251.26. To be paid out of 2009 GO Bonds and other funds.

12. Discussion, Consideration and Possible Action to Action to approve Pay Estimate No. 3 on 2010 Emergency Pavement Repairs to Nash Construction, Inc. in the amount of $25,407.46. To be paid out of 2010 GO Bonds and other funds.

13. Discussion, Consideration and Possible to approve Pay Estimate No. 1 on Project No. WC-1001 to Urban Contractors, LLC in the amount of $32,276.43. To be paid out of 2009 GO Bonds and other funds.

14. Discussion, Consideration and Possible Action to approve Pay Estimate No. 1 on City Wide Pavement Rehabilitation in Nichols Hills to Shell Construction Co., Inc. in the amount of $57,134.25. To be paid out of 2010 GO Bonds and other funds.

15. Discussion, Consideration and Possible Action to approve Ordinance amending the employee retirement system, Defined Benefit Plan for the City of Nichols Hills and Nichols Hills Public Works Authority, Oklahoma; providing retirement benefits for eligible employees of the City of Nichols Hills and Nichols Hills Public Works Authority with the effective date of January 1, 2011.

16. Discussion, Consideration and Possible Action to approve a change order increasing the cost of the fire apparatus by $3,112.52 as recommended by Fire Chief Keith Bryan.
