MINUTES OF A REGULAR MEETING OF THE NICHOLS HILLS CITY COUNCIL HELD TUESDAY,  APRIL 13, 2010 AT 5:30P.M.; TOWN HALL, 6407 AVONDALE DRIVE, NICHOLS HILLS, OKLAHOMA, 73116

            Mayor Hoffman called the meeting to order and declared a quorum present to conduct business.  The Mayor led the crowd in the Pledge of Allegiance.

Motion was made by Councilman Clements, seconded by Vice-Mayor Lippert  to approve the minutes of the regular meeting held March 9, 2010; and the minutes of the special meeting held on March 22, 2010, with one amendment to the heading of the March 22, 2010 minutes to state “SPECIAL” rather than “REGULAR”.

Mayor Hoffman acknowledged receipt of the Oklahoma Department of Environmental Quality, Permit No. SL000055100185 for the sewer line replacement by pipe bursting in-place, which consist of 10,288 L.F. of 8 inch HDPE sewer lines to serve the City of Nichols Hills. Receipt of this permit is so noted in the minutes for the City of Nichols Hills City Council meeting of April 13, 2010.

 

Councilman Clements made a motion approving Amendment No. 2 / Change Order No. 2 in the amounts of $50,550.26 and $5,761.36 respectively for Project No. PC-0701 to Krapff-Reynolds Construction Company.  This amendment/change order increases the original contract amount to $1,614,226.69. Vice-Mayor Lippert seconded this motion.

Approval of Progressive Estimate No. 6 on Project No. PC-0701 to Krapff-Reynolds Construction Company in the amount of $93,259.67; to be paid out of 2008 and 2009 GO Bonds and other funds was made by Vice-Mayor Lippert and seconded by Councilman

 

Clements.  Vice-Mayor Lippert advised others of comments he received from residents along

Straford who expressed their appreciation of the great work and professionalism on part of the contractor.  He requested Public Works Director Charles Hooper to pass that along to Krapff Reynolds.

City Manager David Poole reported to council his recommendation for upcoming miscellaneous road projects for which the $400,000 bond money will be spent.  He stated that over fifteen thousand feet have been identified has needing repairs.  He recommends the focus to be on roads which have not been identified for repair within the next few years which have bond funds currently earmarked.

 

After council members reviewed and heard a report from Andy Cromer, CPA with John M. Arledge & Associates, P.C.  Following the report Councilman Clements made a motion to accept the Comprehensive Annual Financial Report and Accompanying Independent auditor’s report for the fiscal year ended June 30, 2009;  Vice-Mayor Lippert the motion.

Kathy Walker addressed council regarding the placement of banners at the Christ Science Church for the upcoming Earth Day Birth Day celebration which will be held April 22 through April 24, 2010. When asked if EHS had received approval from Chesapeake, she stated they wished to receive the City of Nichols Hills approval prior to contacting Chesapeake.

 

Councilman Clements made the motion to approve placement of banners no larger than 12’ x 4’, in a “V” shape on the corner of Sherwood & Grand on the church property between April 15, 2010 and April 24, 2010.  This motion was seconded by Vice-Mayor Lippert.

Vice-Mayor Lippert, made a motion to ratify and approve Registrar, Transfer Agent and Paying Agent Agreement regarding general obligation bonds with Bank of Oklahoma, N.A.  Councilman Clements seconded the motion.

Vice-Mayor Lippert, made a motion to approve the item as set forth in the proposed minutes prepared by City Attorney John Michael Williams for the sale of $2,400,000 General Obligation Bonds, Series 2010, seconded by Councilman Clements.

Mayor Hoffman read the next item proposing an ordinance providing for the issuance of General Obligation Bonds.  City Attorney Williams stated that the council is legally obligated to read the proposed ordinance in its entirety.  Mayor Hoffman stated that council members will address all other items on the agenda prior to this item.

 

Vice-Mayor Lippert made a motion to table the item regarding the upcoming appointment of expirations on the various Boards Commissions and Committees; Councilman Clements seconded the motion.

Vice-Mayor Lippert made a motion to adopt the Uniform Building Code Commission fee of $4 per building and construction permit as directed by recent legislation and legal requirements by cities; along with assessing a 50 cent administrative fee as allowed by legislation. Councilmember Clements seconded the motion.

Following the request by Vice-Mayor Lippert notification be sent to residents in the 1800 block of Coventry allowing the opportunity whom may potentially be affected by this item be given the option of addressing this item.  Councilman Clements made a motion to invite all residents on the 1800 block of Coventry to make their wishes know at the May 2010 City Council Meeting and tabling further action of this item until the next meeting.  Vice-Mayor Lippert seconded the motion.

Council members received a report from City Manager David Poole regarding the needs of Nichols Hills Town Hall.  Discussion followed regarding some of the issues with the current facility, the HVAC unit(s), roof, computer storage. Mr. Poole advised that immediate needs would cost approximately five hundred thousand dollars.  Vice-Mayor Lippert proposed this discussion continue at next month’s council meeting with a possibly solution of distributing

these repair cost at $150,000 per year for the next three or four years, prioritizing what must be repaired during the first year.

Mayor Hoffman provided information to fellow council members of the initiative by O G & E method of to install Smart Meters in all homes.  O G &E started in Norman, Oklahoma with this initiative, allowing residents to have a tremendously efficient method more effective way to manage all their resources. Mayor Hoffman encourages the City of Nichols Hills to be on the forefront of this initiative to have these new Smart meters installed in the homes.  This results in no cost to the City of Nichols Hills nor the residents.  Councilman Clements made a motion encouraging Mayor Hoffman to continue looking into this as long as there is no cost to the city and/or residents, Vice-Mayor Lippert seconded the motion.

Councilmember Clements inquired as to the requirement that all council members be present during the reading and possible action of the proposed ordinance providing for the issuance of General Obligation Bond. City Attorney John Williams advised that a quorum is required to continue with the council meeting; therefore at least two council members must be present to proceed.  Councilmember Clements exited the meeting to meet another obligation. 

 

City Attorney John Williams read the ordinance in its entirety.  Following the reading Vice-Mayor Lippert made a motion which seconded by Mayor Hoffman to approve the proposed ordinance providing for the issuance of General Obligation Bonds in the sum of Two Million Four Hundred Thousand Dollars ($2,400,000) by the City of Nichols Hills, Oklahoma, authorized at elections duly called and held for such purpose; prescribing form of bonds; providing for a combined bond issue designated “General Obligation Bonds, Series 2010”; prescribing redemption provisions; designating bonds for purposes of certain provisions of the Internal Revenue Code; providing for registration thereof; appointing a paying-agent registrar for the issue and waiving competitive selection thereof; approving the Official Statement pertaining to the bonds; providing for the levy of an annual tax for payment of principal and interest on the bonds; authorizing the approval of a continuing disclosure agreement and other contracts and instruments necessary to consummate sale of the bonds and disbursement of proceeds of the bonds; fixing other details of the bond sale and issuance; and declaring an emergency
